Personal Data Processing Information Notice
ERG Group Companies (“Company”/“Companies”) take the utmost care regarding the security of your personal data. With this awareness, all personal data processed by us as the Data Controller is processed and protected in accordance with the KVKK. With this sense of responsibility, in order to inform you about your rights, this disclosure text has been prepared in accordance with Article 10 of the Personal Data Protection Law No. 6698 (KVKK) and the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Information Obligation, ERG Construction Trade and Industry Joint Stock Company has prepared this information text in its capacity as the Data Controller.
Purposes of Processing Personal Data
Your personal data will be processed in accordance with the fundamental principles set forth by the KVKK and the KVKK’s 5. and Personal data will be processed for the purposes listed below, within the scope of the personal data processing conditions and purposes specified in Article 6;
• ERG İnşaat’ın yürüttüğü projeler kapsamındaki faaliyetlerin sözleşmelere, mevzuata ve şirket politikalarına uygun olarak yerine getirilmesi
• İnsan kaynakları politikaları ve süreçlerinin planlanması ve icrası,
• ERG İnşaat ile iş ilişkisi içerisinde olunan gerçek kişilerin ticari ve hukuki güvenliğinin sağlanması, hukuk işlemlerinin takibi
• Mal / Hizmet Satın Alım Süreçlerinin Yürütülmesi
• Sözleşme Süreçlerinin Yürütülmesi
• Yetkili Kişi, Kurum ve Kuruluşlara Bilgi Verilmesi
• Müşteri İlişkileri Yönetimi Süreçlerinin Yürütülmesi
• Talep ve şikayetlerin değerlendirilmesi ve takibi,
• Fiziksel mekân güvenliğinin sağlanması,
• Bilgi güvenliği faaliyetlerinin sürdürülmesi ve 5651 sayılı kanun gereklerinin yerine getirilmesi,
• Web sitemiz aracılığı ile duyuru ve bilgi paylaşımının sağlanması,
To Whom and for What Purposes Your Personal Data May Be Transferred Your Personal Data;
In order to fulfill our company’s legal obligations, to meet the requirements arising from legislation, to the relevant institutions or organizations,
To the employer, through reporting activities established in accordance with the requirements of the contract signed with the employer,
For the purpose of determining strategy, implementing human resources, financial, and administrative policies, and fulfilling company objectives within the scope of our commercial activities; ERG Group Companies, ERG Construction managers, company officials, shareholders, employees, business partners, persons or third parties from whom services are obtained, consultants, auditors, private law or public legal entities, individuals, SGK, ministries, judicial authorities, and other authorities authorized by law and requesting information sharing, within the country or abroad, in accordance with the KVKK. 8. and It may be transferred within the framework of the personal data processing conditions and purposes specified in Article 9.
Method and Legal Basis for Collecting Personal Data Your personal data;
• Through all forms, including the Job Application Form and Complaint/Suggestion Form, which you fill out electronically on our website,
• Any information and documents you provide to the Data Controller in person, by hand, via the website, email, courier, reference, or similar methods,
• Through reporting activities established in accordance with the requirements of the contract signed with the employer,
• Activities carried out in accordance with contracts signed with subcontractors/subcontractors,
• Through visitor logs, security cameras located at security points, telephone, email, fax, corporate correspondence, and reporting activities,
– Through legal documents and notifications sent to us in order to fulfill our legal obligations,
– Through the commercial processes carried out in order for the Data Controller to continue its commercial activity,
– During the execution, maintenance, development and supervision of our activities in accordance with the relevant legislation,
– Through promotion and similar processes for our activities,
– During planning, statistics, conducting satisfaction surveys, ensuring security, emails, social media posts and interviews with prospective employees,
– By sending the written or electronic CV/application form via e-mail, courier or similar methods,
– The maintenance of the legal and commercial security of persons, determination and implementation of financial/financial, administrative affairs and business strategies, as well as the implementation of the Law 5. and 6. are collected under the conditions set out in Articles 6.
Your personal data collected for these methods and purposes are processed in order to carry out our commercial activities, to fulfill our legal obligations, to establish or execute a contract, to ensure our legitimate interests, to carry out human resources, finance / accounting, information security policies, to ensure physical security and supervision, to comply with national and international legislation, to comply with information transfer and reporting obligations requested by public institutions or other institutions.
Rights of the Personal Data Owner As a personal data owner, as per Article 11 of Law No. 6698. You may exercise your rights set out in the article below. Your rights in this context:
– Learn whether personal data is being processed,
– Request information if personal data has been processed,
– To learn the purpose of processing personal data and whether they are used for their intended purpose,
– To know the third parties to whom personal data are transferred domestically or abroad,
– To request correction of personal data in case of incomplete or incorrect processing and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,
– Although it has been processed in accordance with the provisions of Law No. 6698 and other relevant laws, to request the deletion or destruction of personal data in the event that the reasons requiring its processing disappear and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,
– To object to the emergence of a result to the detriment of the person himself/herself by analyzing the processed data exclusively through automated systems,
– In case of damage due to unlawful processing of personal data, to demand compensation for the damage.
Application Method Regarding the Abovementioned Rights of the Personal Data Owner
You can submit your request regarding your rights mentioned above in writing to the address of the Data Controller “Gaziosmanpaşa Mah. 79/1 Sk. No: 6 M Gölbaşı / Ankara” address of the Data Controller in writing or electronically kvkk@erginsaat.com.tr in writing and signed by filling out the Data Subject Application Form available at “www.erg-insaat.com.tr”.
The Data Controller reserves the right to verify your identity before responding to your request. The Data Controller will finalize your request as soon as possible and within thirty days at the latest, depending on its nature. In this respect, the accuracy of the information you share with the Data Controller is necessary for you to exercise your rights and the responsibility arising from the provision of incorrect information will not belong to the Data Controller. However, if the transaction requires an additional cost, we are entitled to charge you the fee in the tariff determined by the Board.
